1) On February 27, 1991, the respondent-appellant, David Lee Harrington ("Harrington"), was declared an habitual offender by the Superior Court, pursuant to 21 Del.C. § 2802 of the Motor Vehicle Code ("Section 2802"). Under § 2802(1), an habitual offender is defined as a person who, within a five-year period, has been convicted of three or more offenses enumerated in subsections (a)-(k). The Superior Court found Harrington to be an habitual offender based upon four previous convictions occurring within a three-year period and sentenced him accordingly. Only two of these convictions are the subject of this appeal. Specifically, Harrington contends that the Superior Court erred in relying on two convictions under 21 Del.C. § 2701(b), which prohibits driving a motor vehicle without the reinstatement of a valid drivers license.
